Evidence for foreign proceedings
Courts in other countries sometimes need sworn evidence from a witness who lives in Ireland. Rather than the witness travelling abroad, the evidence can be given before a notary, who administers the oath, records the testimony and certifies the deposition for use in the foreign proceedings.
What is involved
- Administering the oath or affirmation to the witness
- Recording the evidence in the form requested by the foreign court
- Certifying the deposition and attaching any exhibits
- Preparing the document for apostille or legalisation where required
Depositions often follow a formal request from the foreign court or the parties’ lawyers. Send us those instructions in advance so the session can be arranged correctly.
